The State of Nevada, through its Nevada Consumer Affairs Unit, is actively investigating MV Realty PBC, LLC, MV Realty of Nevada LLC and certain of their affiliated entities (collectively, "MV Realty") for potential deceptive trade practices.
The investigation focuses on an agreement commonly referred to as the "Homeowner Benefit Agreement," which MV Realty allegedly presented to homeowners as a no-repayment loan or cash benefit.
What Nevada Consumer Affairs Has Identified
Based on information reviewed to date, Nevada Consumer Affairs has identified the following concerns related to MV Realty agreements:
- The agreement may have created a long-term lien (up to 40 years) on a homeowner's residential property.
- Homeowners may be unknowingly obligated to use MV Realty as their listing agent if they decide to sell their home in the future.
- Homeowners may be required to pay a percentage of their home's value in order to release MV Realty's lien.
If you signed an agreement with MV Realty, you may have unknowingly consented to a lien being placed against your residential property.
The State of Nevada is committed to taking appropriate action to address improper liens recorded against residential property and to pursue removal of liens, restitution, and other remedies, as appropriate, on behalf of affected homeowners.
